WHAT ARE [YOUR] PTO'S GUIDELINES IN REGARDS TO REMOVING AN OFFICER FROM OFFICERSHIP??

23 years 7 months ago #94293 by Nancy
I would never have thought that our PTO needed to have a provision for removing an officer in our bylaws, but earlier this year we did have a situation where a parent felt that the expressed opinions (completely outside of school)of one of our board members was not consistent with the school's non-discrimination policy. This parent felt very strongly that this person should be removed from the board, and without a provision for handling the situation in our bylaws, we really didn't know to handle it. It was very difficult also to figure out the truth in the face of different accusations flying back and forth about who did and said what, when, etc. It would have been great to have had a policy to refer this parent to so that she could take it on herself to pursue it, rather than expect the board to just remove the officer based on her allegations. From what I have learned here today, I am going to propose that we amend our bylaws to include a provision for this in the future.

In reply to the question concerning my post. We would not "have legal action taken" against someone if we did not have the proof that they did wrong. In other words our ducks would be all in a line and we in our case we had the proof that the treasure had taken the 16.000 before we took legal action.

I just posted my own question which the answer could lead to this type of action. I am the Secretary of the sitting PTO (my term ends this May and am not running again). Our President has been acting like a maniac towards certain people but not to all parents and teachers. She has done a great job so far but there is a dispute about the elections just held. I have been a board member for four years and have been totally kept in the dark about the normal practices of the PTO. I have been told since our dispute of elections that we have no by-laws. I am trying to get in touch with our old principal to see if he can recall whether we indeed had by-laws. I am not sure if there are any legal ways to impeach our President. If you have any comments or suggestions please e-mail me back.

We had to find a way to remove our President, who was out of control, offending teachers, staff, volunteers, everything she touched became a mess. We finally revamped our bylaws, including a removal clause. We passed the bylaws, AND removed the problem in the same meeting. That required a clause that I wouldn't recommend, but one more month in our situation, and we wouldn't have had an organization left. It will likely need to be changed in the next year, but the overall result was what we needed. We got Bylaws that are more comprehensive, and our organization back! Good Luck, from one who's been there!

DOTTIE:
Are you saying that any member that has "legal action taken", even if proven innocent is grounds for dismissal from PTO? If so that would seem unjust like punishing a person for someone elses wrongful accusation. That's just sooo unamerican!
