If you are a "PTA" then you have to have Bylaws that are "approved" by your State's PTA. It could be you have them and they're just not in your VP notebook. If you are a "PTA" first thing you do is contact your state PTA and ask if your local group has a set of Bylaws on file and to please send you a copy. You can then make copies for all the officers which it sounds as if no one has. If they do not then you ask what your next step should be and explain the circumstances. They will be very helpful. To be a PTA in good standing you have to have a set of "approved" Bylaws and then remit membership dues each year.
If you are not a PTA and you applied for 501c3 status I can promise you the IRS will not grant this status if you don't have a set of Bylaws and you even have to have a "Conflict of Interest" policy. I know this because last school year our middle school started a PTO and we went through the entire process. I hope that's helpful. Good luck!

Are you sure you are actually a PTA? I don't understand how you can be a PTA without bylaws; there is usually a standard template for each state, and the first thing you have to do is adopt bylaws to become a PTA. Also, I don't know of any state where you would have to apply separately through the IRS to receive tax exemption as a PTA.

And if you did apply separately to the IRS for tax exemption, your bylaws, or at least the process by which you select officers, would probably have had to have been attached to the IRS application.

Hi,
I am a first term VP for a small school this is the second year of the school having a PTA and the schools 3rd year of operation.
The previous PTA applied for and received a non-profit designation thru the proper IRS channels. The ISSUE is that is where it was left off. The current PTA still has not adopted nor approved bylaws. I have even went as far as researching and submitting my own bylaws just to be told that the President wants to take the samples home and go over them before making a decision as to what the PTA will vote on ???? Am I out of line here? We have had 5 weekly meetings without one thing accomplished, last week they took a vote of all present to turn down a fundraising idea approved 4/0 by the fundraising committee???? Anyone that is present can vote and the officers were elected simply by the school secretary saying you have the job of .... HELP this seems so wrong?!??
