Yes and no...first you do need to file your bylaws or articles of constitution with the irs to get tax exempt. there is one clause that NEEDS to be in there about if the school seizes to operate where the money goes. I dont have the exact wording in front of me but can get it if you need if. You don't however need a lawyer to do your bylaws...that would be a waste of money.There are plenty of people on this site who have gone through this whole thing writing bylaws and getting tax exempt. I did our paperwork for the 501 by myself with help from jhb,critter and pto today!

We have been working on getting some bylaws in place for our PTO. A fellow PTO memeber just informed me after a converstaion with some at another school. Said we need to have our by-laws filed with the IRS to get our tax exempt number. That they need to be done right and by a lawyer. I am really getting confuesd on this. Is any of this true? With alot of what I have read on here and researched, this is the first time I have heard of this. Please help?
