Slander vs. freedom of speech

18 years 10 months ago #60782 by mykidsmom
This is what is wrong with today, my daughter was asked if she is a lesbian and the school has done little to nothing (so far) but expose vital information that someone has commited a crime and you are violating that person.

sorry, it's been a tough day......

I don't see how you could be held liable for slander or libel. For that they would have to prove you were running around here with maliciously intent to harm someone's reputation.

If it makes you feel any better my group is no better. Ask a question or present anything with less than a rosy outlook and you're labeled a "trouble-maker"--your sole intent on making everyone feel bad and rather than trying to make things better.

I agree with LUVMYKIDS. Since names nor the school are not mentioned, I don't see slander & you were just asking for advice. Maybe a few people on the boards see a similar situation at their school & think it's themselves. Some of the first timers to these boards don't do enough research here to realize that these boards are for help/advice to pto/pta problems. Good luck!!

I'm no legal expert, but if you don't give your name, or the name of your school, or anyone involved in the situation, I wouldn't see how you could be charged with slander. You were seeking advice from a source you thought would be helpful. However, I guess we all must remember that this is a public forum and what we say can be read by anyone with access to a computer.

Anybody who knows for sure?? Got me curious.

Hey Rocky, watch me pull a rabbit out of my hat.

I posted some questions on this forum for advice and feedback from others regarding our PTO run 'amuck' - I have called for a formal audit and there appears to be embezzlement by an officer. Since I was the first to stand up and ask for accountability, I am being crucified and vilified. If I didn't provide any identying information in my posts, am I guilty of slander or any other crime. The situation is getting really messy [and sad] but I really feel that once the facts are known, there are enough honest and sensible people to see and decide for themselves to take back responsible leadership and management of our school again. Many good people have just stepped away over the past few years because its easier not to fight for what is right!!
Any one who could share any experiences, advice and/or resources regsarding the legal ramifications would be most welcome. The people in the wrong are trying to avoid/deflect responsibility by blaming a few of us for asking for basic accountability and ethical behavior.
Thanks to all for being a place to vent and be encouraged - I am, dazed & confused!!!!
