There is no "PTO law". Each group has their own bylaws unless they are a PTA, then there is a set of PTA rules. That said, the basis on which the decision as to whether this person can serve or not is the section(s) in your bylaws defining what constitutes being member of your group and what qualifies someone to be a board member. If your bylaws state that you need to be an official member to be on the board then you need to determine if this person qualifies as an official member. Do your bylaws require that members have a student currently in the school? If so, then she would be disqualified from membership and therefore from serving on the board. If that restriction is not a part of your bylaws(or if there is no other requirement that would disqualify her from being a member), then she has every right to serve on the board.
If she is qualified to be a board member, do you have a problem with her serving? Believe me I've been through district changes and schools getting combined and there will be enough issues for your group without making waves about an officer's qualifications. I also think your board and the board members from the other schools should sit down together and try to come up with a plan to include all of them for this school year, so that all of your parents will see familiar faces in a leadership role within the group.

#1: It's not full stated in our bylaw that this can not be done. And I think that it is unethical, but ring in on this.
**We were a small PTO (about 5 members 3 board members for 600 kids!! I know) and this year we are being redistricted and adding new people to our board family. YARA!! I was very excited to hear that more parents were wanting to be on the board. The Pres and other exec were coming from a different school, great! We need order to this PTO. The Orginial President is staying on, GOOD! But the VP postion was being held by a 5th graders mom. She does not currently (2008-09 year) have a child with in the school. She will next year(2009-10year) a child will be in K. The by laws only state that anyone with the pto membership can be a board member. But ethical should she hold the VP postion if there is no child with this school year?
But I think VP should go to the Pres from the other school, Right! I don't want to upset my friends but,>>>>?!:confused:
#2 does anyone know the pto law to say that this is unlawfull? There is no amendment.
