Well just after receiving notice of the vote, the jack booted PTA police will parachute in and take over all PTA assets....just joking
Not sure what state you are in, but the rules governing transfer of assets laid out in the state by-laws often are there to comply with IRS regulations on non-profits.
Best practice is to spend down your account to $0, buy something really needed for the school.
Get your EIN number, open a new account, get the group incorporated unbder your state's laws, and then get your own 501 c3 non-profit status.
We will be holding our disbanding vote tonight!!! Assuming the vote passes, how long does the PTA usually take before they try to take our money, assuming they will in fact try? I plan to get our EIN and open a bank account tomorrow, and we have some checks we have not yet deposited. Do we have a few days to spend down our money after the vote?
Also, the PTA bylaws (not our school PTA's) say that they can take our records, books, etc. What is the best, most PC way to say "no way?" What is the best way to stall them trying to get our money?
I know we don't have to be PC, but we want to try to keep the peace as much as we can.
