Our bylaws were not as specific as plw's. When we made the change, we talked about it at one meeting and put that discussion in our minutes that go to everyone and then we voted on it at the next meeting. After we told the state, a few people tried to say that we did it wrong, but we were already a PTO. We'd already got the new legal stuff and we weren't paying PTA dues, so there wasn't much else to it.

Good luck to you. I have heard that when you change from PTA to PTO you MUST gift all remaining funds to the school. If this is not done PTA can come in and take all funds. You are able to alocate the funds to what ever function you would like but all those fund have to be used for that catagory only. Take you time in this matter. Our PTO had a very rough year with this transition. I still do not know if we have made it yet and I am the new PTO president for the up coming year. Best wishes Syrl

As far as disbanding your bylaws should explain in fairly good detail what you need to do.Our bylaws states under Basic Policies Article IV Section 23. a. If a motion to disband is presented and seconded, it must be deferred for vote until the next meeting. (so it will take at least two meetings, as all bylaw changes do) All members shall be notified by first class mail, along with the district director and the State PTA office, thirty (30) says prior to the meeting at which the vote will be taken on the motion to disband.
b. At the next regular meeting, the motion to disband is opened for discussion. A two-thirds (2/3) vote of members present and voting is required for the motion to be adopted. However, before the final vote can be taken, the members must decide how to dispose of teh property and assets of the unit in accordance with Section 501(c)(3) of the Internal Revenue Code The books, records and the unit's Charter shall be returned to the State PTA office by registered mail or given to the district director.
c. When the dissolution vote is taken, IRS shall be notified that this unit is no longer a tax exempt organization of the State PTA.

I am from New Jersey.We are going to try and tell the PTA that we no longer want to be part of theie assocciation.
Two questions: can we disolve the PTA regardless All of the officers including myslef are recently elected.
What are the proper procedures and or recomendations for forminf a PTO? BAsically what do we have to do?
