At our school, parents must contact the school in writing if they do NOT want their student's name/photo used. To me,that suggests everyone else is giving permission by their non-action.
IANAL, but my understanding is that the answer is "No." The yearbook is produced within the school setting for distribution within the school setting. Thus, a picture in the yearbook is in a private forum, and has not been published in a public forum. Therefore, it should not be necessary to obtain a release.

Our principal has advised that anytime we publish a child's face with a name, we need to have parental authorization. Does this apply to yearbooks? Does anyone have a sample permission form?
