Do you store your equipment in the school-owned concession building? Are you charged a rental or storage fee by the school? I'm guessing first answer is yes and second is no.
If that's right, then that's where the cooperation comes in. If you own the equipment, no one can tell you what you "must" do with it. But he or she can certainly tell you you can no longer store your equipment there or use the concession. I call it -- mutually assured destruction (like the old Cold War). Neither one of you can tell the other what to do, but you're both highly incented to find common ground.
Does the principal have the right?
The PTO has been running for many of years. The PTO’s main fundraiser is to run the concessions for all events. We have the different club/sporting groups ect. working the concessions and we in return give the group that is working some of the profits to go towards items that are not in there budgets. The remaining profit is directed in other areas of the school.
Our PTO has been challenged this year. The band has decided to host a band competition and they want to run the concessions without the PTO’s involvement. Understand The PTO owns the equipment but not the building. The PTO is using the concession on the same day that the band is recommending use of it. The PTO board has met on several occasions to try to and come up with a solution for us both working together and profiting from this event. But the band is not interested in both profiting. The PTO feels that giving the Band the concession to run on there own is opening up a can of worms. Now all groups will want to do this and PTO is out of business. With this being said the PTO board voted that we are unable to accommodate the band this year. The Asst. Principal was informed of this and agreed with the PTO decision. The band representative did not like this decision and took it to the Asst. Principal and changed his mind. Now The Asst. Principal has over ruled the PTO board. And is letting the band use the building (which is school property) and letting band use the PTO’s equipment without a rental fee, or making them responsible for any damage. The PTO wants to know if this is something a principal or an Asst. principal can do. If so then what is the reason for having a board if they can over rule your decision. And if PTO purchased the equipment how can the Principal have a voice in who uses PTO’s equipment?

ARTICLE 3
Membership, Dues and Voting
Section 3.1 Membership: Membership of the Royal Pride is open to parent(s) or legal guardian(s) of students enrolled at Hamilton Southeastern High School and all teachers and staff.
Section 3.2 Dues: All eligible people who pay the memberships dues shall be accepted as a member of the Royal Pride for the period to which the membership fee applies. These people will be considered members in good standing. The Royal Pride Board will determine dues for members and staff on an annual basis.
Section 3.3 Voting: Each member in good standing is entitled to one (1) vote.
ARTICLE 5
Boards
Section 5.1 Executive Board: The Executive Board of the Royal Pride shall consist of the elected officers: President, Vice-President, Secretary and Treasurer.
Section 5.2 Royal Pride Board: The Royal Pride Board shall consist of the Executive Board and committee chairpersons.
Section 6.2 Duties: The following will be the duties of each officer:
a. President. The President will preside at all meetings of the organization, and will be a member ex-officio of all committees. The President will serve on the Superintendent’s Advisory Council, and will perform all other duties pertaining to the office.
