I've never heard of a School Site Council being a 501c3 before- all that I've been involved in consisted of 51% parents and 49% school staff (approx 11 members total)- they main functions were school plan, school program (curiculum), budgeting of school monies - nothing involved fundraising or PTA/PTO prgrams of fundraising.
Need more info on how the PTO, Foundation and Site Council is/are
If that is true you could always have PTO do no fundraising (no PTO chair of sally Foster, no volunteers, no running the fundraisers, etc) at school (and only accept inkind or monetary donations to the PTO from parents, businesses, etc)

I am a new Chair of a PTO group. After reading many posts I figured I would give my question a try. Our school has a PTO, Site Council, and a Foundation. In the past, the net profit money raised from our three major fundraisers were turned over to our Foundation. Which is our 501c3 entity. They in turn awarded grants to the staff etc...
Last year our Site Council decided that they wanted more control over the fund-raising monies. So they voted to set up a separate "recommendation" committee. The new committee reviews the grant requests and refer their recommendation to the Site Council for final approval. The new 501c3 entity charges 5% of the gross amount for admin costs. Completely taking our Foundation out of the loop.
The Site Council claims to have the authority to make this decision as they are the "policy" decision makers. The policy is that all fund raising money will go through this new account. This is however not the case. It is only the money raised by the PTO that use to be given to our Foundation that is being sent to the new account and committee.
There has been a range of emotional feelings from our current PTO. We have contacted the District and they sent in lawyers informing us that the Site Council has the power to take the fundraiser monies from the Foundation and that the PTO has no say in where the money is spent. Yet they haven't been able to provide me with any written District policy, leadership structure chart, or much other then the Site Council by-laws.
Any of the written documentation is very vague and no where do I read that the Site Council has authority to take another entities revenue. Any ideas of where to go from here? thank you for your input!
