It sounds like to settle the issue, the whole organization should vote on going on with the fundraiser or not. It shouldn't be the decision of the President as to whether to honor the former President's commitment or not.
THANK YOU...I FEEL AS THE EX PRESIDENT IN ORDER TO SAVE FACE WITH THE COMPANY WHOM I WOULD LIKE TO DEAL WITH IN THE FUTURE I COULD DO SOMETHING TO HELP. I DO KNOW THAT NO BYLAWS HAVE BEEN PRODUCED AS OF DATE TO SUPPORT THE CURRENT PRESIDENTS REASONING FOR NOT HAVING THIS FUNDRAISER ALREADY SIGNED FOR FOR 2004-2005 SCHOOL YEAR!
Normally, a person acting on behalf of an organization, like it's President, enters into an agreement, it is binding even if the individual leaves the organization. If you're talking about a fundraising contract, talk to the company and see if you can work out the issues. Unless they have spent money on your fundraiser already, they are pretty good about voiding the document. If they insist on upholding it, ask an attorney to review the contract and your options.
I WAS WONDERING IF ANYONE WAS AWARE THAT IF A PRESIDENT RESIGNS 3 MONTHS AFTER SIGNING CONTRACTS FOR THE UPCOMING 2004-2005 SCHOOL YEAR DOES THE CURRENT PTO/PTA HAVE TO HONOR THOSE CONTRACTS?
ALSO IF THE REASONING WAS THAT THE PERSON WHO SIGNED THEM IS NO LONGER IN OFICE IS THAT VALID AS AN EXCUSE TO GET OUT OF THE FUNDRAISER WITH THE VENDOR?
