Question: fundraiser liability

Our PTO would like to supplement the holiday shop with items bought from local stores and resell at the shop. If a child gets hurt on one of these items is PTO liable because of the resale?

Liability is a complex topic, but if someone blamed your group they could certainly file a lawsuit. Does your PTO have insurance? If so, check with the carrier to see whether you're covered. If not, check with the school to see whether the school policy would cover you. (The answer usually is no.) Here's some information about types of insurance for PTOs that might help.
